Investigations into Pricing Practices Launched by CMA

The Competition and Markets Authority (CMA) has initiated three new investigations aimed at protecting consumers, amid concerns regarding the transparency of pricing in the purchase of train and coach tickets, holidays, and driving lessons. These inquiries are part of a broader initiative by the CMA to combat misleading pricing practices that can leave consumers facing unexpected costs.

One of the main issues under scrutiny is the practice of “drip pricing,” where mandatory charges are not included in the initial price displayed to customers. This practice can result in consumers needing to calculate the actual cost themselves, leading to confusion and dissatisfaction. Furthermore, businesses employing such tactics may appear to offer lower prices than competitors, thereby distorting fair competition.

Specific Companies Under Investigation

The CMA’s investigations have identified specific firms that may have violated consumer protection laws. The first is Trainline, which is being examined to determine if all mandatory fees are included in the upfront prices displayed for train and coach ticket purchases. Fees observed by the CMA ranged from £0.59 to £2.79 for train journeys, and a £1.50 booking fee for coach reservations, which can accumulate significantly for frequent travellers.

Another company under scrutiny is Virgin Atlantic, focusing on whether the mandatory resort fees and local taxes have been factored into the upfront prices shown for package holidays. These additional costs can vary greatly and may add hundreds of pounds to the overall holiday price, impacting consumer choice.

RED Driving School is also being investigated regarding the display of mandatory booking and digital fees, which exceed £7 per booking. The inquiry aims to ascertain whether these charges are included in the total price presented to customers when booking driving lessons.

CMA’s Approach to Consumer Rights

All firms currently under investigation received advisory letters as part of the CMA’s initial consumer protection efforts using its enhanced enforcement powers. However, should any breaches of the law be identified, the CMA has the authority to impose fines and mandate compensation for affected consumers, with potential penalties reaching up to 10% of a company’s global turnover.

She stated, “It is crucial that consumers are not taken by surprise by additional fees when booking services. Transparent pricing enables individuals to compare offers confidently and select the best option for their needs. Unexpected mandatory charges complicate this process, which is why we have initiated formal investigations.”

These investigations are part of the CMA’s ongoing efforts to alleviate cost of living pressures for consumers. Since the introduction of enhanced consumer powers, the CMA has launched several investigations across various sectors, including ticketing, gyms, and air travel. This initiative has already resulted in the recovery of over £1.95 million in refunds for UK consumers and fines totalling approximately £6.2 million imposed on companies found to be in violation of consumer laws.
