Skip-Hire Executive Receives Suspended Sentence for Criminal Activities

The proprietor of a waste management business located near Braintree has received a six-month suspended prison sentence following a series of environmental violations. The case against Roy Brett unfolded at Chelmsford Magistrates’ Court, where the judge highlighted Brett’s “repeated failure” to heed warnings from the Environment Agency concerning overflowing skips and improperly covered waste.

Environmental Risks and Legal Consequences

During the proceedings, it was revealed that Brett’s company, RJ Brett Contracts Ltd, had previously been fined £3,000 for similar infractions. Chair of the bench, Andrew McGregor, expressed concern that the site presented numerous hazards to both the environment and public safety, particularly in relation to fire risks.

Over a period spanning from 2024 to the present, Brett consistently disregarded orders to clear waste that had accumulated from an increasing number of skips at the site. His inaction jeopardised the environment surrounding the small yard at Cressing, which lacked proper drainage and was left exposed to the elements.

Despite the picturesque setting of Brett’s yard amid green fields, he continued to neglect the escalating issues of waste management. The site was cluttered with wood, metal, textiles, and construction debris, leaving little room and creating a significant fire hazard, with much of the waste lying directly on the ground.

Failure to Comply and Subsequent Charges

Brett claimed that he “didn’t do e-mails,” suggesting that he had “missed” written directives to remove the waste. However, the Environment Agency also made personal visits to issue warnings. Furthermore, Brett lacked the necessary environmental permit to operate the yard. Eventually, after evading numerous challenges from the Environment Agency, he admitted in court to violating environmental regulations, leading to charges against both him and his company.

Should he commit any further offences or fail to clear the site by November, Brett could face imprisonment. Lesley Robertson, the enforcement team leader for the Environment Agency in Essex, Norfolk, and Suffolk, remarked that it was implausible for someone with Brett’s experience—being the director of three other waste companies—to claim ignorance regarding the need for an environmental permit. She noted the unfair competitive advantage he gained by avoiding requisite permits and fees.

Fire Safety Concerns and Further Investigations

Concerns about fire hazards at the site were also raised by Essex Fire and Rescue Service, who advised Brett to tidy the area and prevent the introduction of any waste that could ignite. An investigation by the Environment Agency commenced in July 2024, unearthing over a dozen skips overflowing with waste. Brett was given three months to rectify the situation.

When officials returned post-deadline, they found no improvement. Brett was warned that failure to clean up the site would result in prosecution. By early 2025, the number of skips had swelled to nearly 50, some precariously stacked, alongside large piles of wood and soil, compounded by unpleasant odours.

Legal Ramifications and Penalties Imposed

In an attempt to legitimise his operations, Brett sought to register exemptions from environmental permits intended for low-risk activities. However, the Environment Agency revoked these exemptions when the site took on excessive waste. In addition to being ordered to remove all waste, the 66-year-old, residing on Winstree Road in Stanway, Colchester, was sentenced to six months in prison, suspended for 18 months. He must also complete 30 days of rehabilitation activities and pay a £154 victim surcharge. RJ Brett Contracts Ltd was fined £3,000, along with a victim surcharge of £1,200.

The charges against RJ Brett Contracts Ltd included operating a waste facility without an environmental permit and failing to comply with removal notices, both of which are serious violations under the Environmental Protection Act 1990. Roy Brett himself faced similar charges, having contributed to these infractions knowingly.
