Court Order Imposes Waste Import Ban at Park Head Plantation

A court order has been enacted to prohibit the importation of waste onto land designated as Park Head Plantation, located within the North Pennines Area of Outstanding Natural Beauty in Wolsingham. The order not only forbids the import of waste but also restricts access to the site itself.

This Restriction Order was issued by the County Durham and Darlington Magistrates’ Court on Wednesday, 15 July, and will remain in effect for a period of six months. It is important to note that violating this Restriction Order constitutes a criminal offence.

The court’s decision was prompted by reports of illegal waste dumping on the property. Previous enforcement actions taken by the Environment Agency, which mandated the cessation of dumping activities and the removal of waste, were disregarded.

Ongoing Criminal Proceedings Against Offenders

In conjunction with the closure of the site, the Environment Agency has initiated criminal proceedings against individuals believed to be responsible for operating the site and for unlawfully depositing waste there. These proceedings are currently underway.

The Environment Agency’s intervention is part of a broader initiative to intensify efforts against suspected waste crimes, aligning with its 10 Point Plan, which aims to enhance the use of restriction notices and orders to combat illegal waste dumping effectively.

Gary Wallace, the Area Environment Manager at the Environment Agency, stated, “We’ve taken action to shut down this site after reports indicated that illegal waste dumping was persisting. Waste crime inflicts significant damage on communities and the environment, and in line with our 10 Point Plan, we’re acting swiftly to address such illegal activities. This site is now secure while criminal proceedings are ongoing.”

Firstly, they should verify the credentials of any waste carriers by consulting the public register before engaging their services. If a carrier is not listed on this register, they are operating unlawfully.
