Realising the major projects necessary to fulfil the UK’s net zero commitments, enhance energy security, and bolster economic growth requires effective environmental regulation. Developers of nationally significant infrastructure frequently face a maze of intricate environmental requirements that involve multiple regulators. While these protections are crucial, the engagement process with regulatory bodies has not always been as streamlined as it could be.

In April 2025, an independent review conducted by Dan Corry highlighted this fragmentation as a significant obstacle to both sustainable development and nature recovery. One of the key recommendations was the establishment of a Lead Environmental Regulator (LER)—a singular coordinating body that would provide developers with clearer, earlier, and more consistent environmental guidance, while ensuring robust environmental protections remain intact. The government accepted this recommendation, and the Environment Agency has taken a pivotal role in conceptualising and implementing the subsequent pilot programme.

Understanding the Role of the Lead Environmental Regulator

The LER model designates a single regulator as the primary contact for developers throughout the planning, permitting, and licensing stages. This regulator is responsible for coordinating input from various regulatory partners to ensure that advice is harmonised and delivered as early as possible. The objective is to minimise duplication, circumvent unnecessary delays, and provide developers with enhanced clarity regarding environmental obligations.

Rather than overseeing the entire regulatory lifecycle, the pilots concentrate on specific stages or activities within a project. The aim of the LER is to improve coordination and facilitate early issue resolution within these defined parameters, without influencing decision-making beyond the pilot’s scope. This clarity ensures realistic expectations and allows for an equitable assessment of the pilot’s impact.

It is vital to note that this model reforms the coordination of regulation rather than altering the requirements themselves. All statutory duties, including Environmental Impact Assessments, permitting standards, and mitigation responsibilities, remain fully applicable. By adopting a comprehensive perspective on environmental risks and opportunities, the LER approach seeks to bolster the delivery of environmental protections while expediting the overall process.

In instances where technical disagreements between regulators cannot be settled through routine collaboration, the LER framework provides a clear escalation pathway to Defra’s Infrastructure Board. This body, established in response to the Corry Review, aims to tackle environmental challenges early in a project’s lifecycle before they evolve into significant obstacles. Although the Board does not make regulatory decisions, it offers structured problem-solving support and governmental oversight.

Insights from the Pilot Projects

Each pilot incorporates three formal evaluation points: at commencement, approximately four to six months in, and at ten to eleven months. These assessments will evaluate both regulator and developer perspectives on whether the LER approach yields earlier issue identification, clearer guidance for developers, and reduced redundancy among regulators.

The LER programme aligns with Defra’s Plan for Change commitment to expedite 150 major infrastructure decisions during this Parliament. The Environment Agency currently leads four of the ongoing pilots, which include:

East West Rail Pilot Overview

East West Rail is a significant new railway project connecting Oxford, Milton Keynes, Bedford, and Cambridge, aimed at improving connectivity across the Oxford-Cambridge growth corridor and alleviating road congestion in one of the UK’s rapidly expanding regions. It is projected to generate £6.7 billion in economic growth, facilitate up to 100,000 new homes, and link 3.5 million individuals across the corridor.

Launched on 1 January 2026, the East West Rail LER pilot was the first initiated by the Environment Agency. The project has now entered an active phase of environmental regulatory engagement, and its complexity serves as an excellent test case for the LER model. Key environmental considerations include multiple river crossings, flood risk management, water quality, and habitat connectivity. The Environment Agency is working closely with Natural England and the Forestry Commission to provide synchronised advice to the developer.

Lighthouse Green Fuels Pilot Overview

Lighthouse Green Fuels (LGF), announced as an LER pilot on 9 April 2026, proposes a second-generation Sustainable Aviation Fuel (SAF) facility at Seal Sands, Billingham, in Teesside. Once operational, it will be among the largest SAF facilities in Europe, converting approximately 1.5 million tonnes of biogenic waste and residues into over 180 million litres of sustainable aviation fuel and around 30 million litres of green naphtha annually. This initiative supports the UK’s Jet Zero Strategy and broader decarbonisation efforts.

LGF is particularly suited to the LER pilot due to its scale, technical complexity, and substantial marine infrastructure requirements, which include a new quay, dredging, and piling. This necessitates close coordination among regulators. The Environment Agency will spearhead collaboration with Natural England, the Marine Management Organisation, and the Planning Inspectorate to ensure clear and efficient regulation while upholding stringent environmental standards, such as environmental impact assessments and marine ecology safeguards.

Sizewell C Pilot Overview

Nuclear new build projects are inherently intricate and typically span many years, necessitating rigorous management of environmental and safety risks. The Environment Agency serves as the independent environmental regulator for the nuclear sector in England, overseeing potential impacts on people and the environment for sites like Sizewell C through the issuance of environmental permits.

Key environmental concerns encompass water resources, waste management, discharge permits, ecological impacts, marine risks, coastal erosion, air quality, and long-term radioactive waste management. The Environment Agency has been involved with the Sizewell C project since 2010, and the LER pilot formalises and enhances the established working relationship with Natural England and the Marine Management Organisation, promoting more coordinated environmental advice during the construction phase of the power station.

Trelavour Lithium Project Overview

The Trelavour Lithium Project is a proposed Nationally Significant Infrastructure Project (NSIP) located near St Dennis, Cornwall. It aims to repurpose a former china clay pit at Trelavour Downs for lithium extraction, processing, and refining. As an NSIP, the project will be subject to the Development Consent Order (DCO) regime under the Planning Act 2008.

Developed by Cornish Lithium, the facility is expected to produce up to 10,000 tonnes of battery-grade lithium hydroxide annually, thus strengthening the UK’s domestic battery supply chain. Announced as an LER pilot on 4 June 2026, this complex scheme is at the pre-application stage, providing an opportunity to positively influence environmental outcomes early in the design process. However, its reuse of former china clay pits alongside new lithium technologies in a sensitive setting also presents unique regulatory challenges. Key environmental issues include water resources, waste and land impacts, air quality, habitat loss, and noise.

Additional Pilot Projects Underway

Three more pilots are currently in progress, led by other regulatory bodies. The Lower Thames Crossing was the first major infrastructure project selected to pilot the LER approach under Natural England in July 2025. This project involves a new road connecting Kent and Essex via two 2.6-mile tunnels beneath the River Thames.

Natural England is also heading National Grid’s Great Grid Upgrade projects, which have joined the LER pilot programme. Meanwhile, Falmouth Docks, which involves the redevelopment of deep-water dock infrastructure in Cornwall, was the second pilot announced and is led by the Marine Management Organisation. Additional projects may be added to the pilot programme as other suitable candidates are identified.

Reflections from the Chief Regulator

As Chief Regulator, I have been heartened by the insights emerging from the initial stages of the LER programme. Our role as an environmental regulator is crucial in ensuring that sustainable growth and energy security are achieved while safeguarding and enhancing the environment. We must adopt a risk-based, proportionate, effective, and efficient approach. Although the LER pilots are still in their early stages, the overall trajectory appears promising.

Since January 2026, efforts at East West Rail have centred on establishing new methodologies and embedding the single point of contact model. Both developers and regulatory teams now possess a clear understanding of the LER’s purpose, particularly as a focal point for risk discussions and issue escalation.

Feedback from the Lower Thames Crossing pilot indicates that closer collaboration among regulators is facilitating the earlier identification of emerging issues and better alignment of regulatory positions, ultimately helping to surface challenges sooner and mitigate the risk of last-minute surprises.

Our newer pilots, Lighthouse Green Fuels, Sizewell C, and the Trelavour Lithium Project, will adhere to the same structured evaluation framework. Findings from these initiatives will contribute to a broader programme evaluation set for early 2027, offering a moment for transparency regarding what is functioning effectively and where enhancements are necessary.
